I'm a convicted felon, but can my wife still own a gun and keep it in our home?

A: "It depends. If your terms of release state that you cannot have a firearm in the residence at all, then the answer is simply 'no.' However, if that's not the case and your wife wants to own a firearm, you would want to make sure that it's kept in an area of the house where you do not have access typically, because there's something called 'Constructive Possession' and what that really means is a place where you might have access to it readily. So, to avoid any accusation of 'Constructive Possession' I would recommend that your wife keep that firearm locked in a safe, to which you do not have the combination.
