Centralia man convicted of child rape to face new trial

CENTRALIA, Wash. (AP) _ A Centralia man whose 2014 conviction for child rape was overturned by an appeals court earlier this year is set to get a new trial.

The Chronicle reports (http://bit.ly/29emrgf ) 41-year-old Paulo Botello-Garcia appeared in court Monday without an attorney on an amended list of charges related to the same 2012 case. A judge appointed David Arcuri to represent him.

Botello-Garcia had been sentenced to 30 years in prison after being found guilty of child molestation and child rape.

Botello-Garcia had appealed his sentence and conviction, arguing that the trial court should not have included evidence about a previous encounter with the alleged victim. The state Court of Appeals agreed, and overturned the jury's verdict.

Court documents allege Botello-Garcia molested a girl over a three-year period starting when she was 11.
