Attorney: Mother accused of killing child has mental disease

ASTORIA, Ore. (AP) _ The attorney for a mother accused of killing her 2-year-old daughter in Cannon Beach says the woman suffers from a mental disease and is unable to continue with her trial.

The Daily Astorian reports ( attorney Lynne Morgan asks for a competency examination of 42-year-old Jessica Smith in a defense motion filed Monday.

Smith has pleaded not guilty to murder in the 2014 drowning death of her toddler and not guilty to attempted murder in the slashing of her teenager.

She is an inmate at Tillamook County Jail, whereshe was evaluated by the state’s psychologist after refusing multiple times. The prosecution also says Smith met with the defense’s psychiatrist multiple times.

Results from the examinations have not been released.
