49ers star linebacker gets probation for drunken driving, possession of rifles

SAN JOSE, Calif -- The San Francisco 49ers star linebacker Aldon Smith was sentenced Friday to three years probation instead of jail time for drunken driving and possession of assault rifles, the San Jose Mercury News reported.

Smith must also serve 11 days on a work crew and pay a $2,000 fine, the newspaper said.

"I would like to apologize for my actions and let you know I will follow any orders you give me," Smith told the judge, according to the Mercury News.

Smith pleaded no contest in May to misdemeanor drunken driving and three felony counts of possessing illegal assault rifles. The judge reduced the felony gun charges to misdemeanors, saying Smith exercised "poor judgment."

Smith could be facing discipline from the NFL for the incident, which stemmed from a house party in June 2012 in which uninvited gang members stabbed Smith and shot two other people.
