Skechers sends out $40M in refund checks

SEATTLE -- More than half a million refund checks -- 509,175 to be exact -- are in the mail for consumers who bought a pair of toning shoes by Skechers.

The $40 million dollar payout comes after the FTC fined Skechers for allegedly using "deceptive marketing" to promote its Shape-ups shoes. The shoes claimed to help people lose weight by strengthening and toning their legs and backside.

Celebrities like Kim Kardashian and Brooke Burke were often featured in the Shape-ups ads.

But if you didn't file a claim, it's too late as the deadline to do so has passed.

Consumers who get a refund check in the mail must cash it before Oct. 10. The refund amount a consumer will receive is based on a portion of their claim that was approved.
