Marijuana patient sues state after daughter gets sick

SPOKANE, Wash. (AP) _ A medical marijuana patient is suing the state after his daughter developed a medical condition while in state care. William Fisher fought for custody of his infant daughter because social workers wanted him to undergo drug treatment.

The Spokesman-Review newspaper reports (http://goo.gl/zeUtmP ) he eventually won the custody battle, but his daughter got sick while in foster care.

Fisher has filed suit against the Washington Department of Social and Health Services in U.S. District Court. He says the girl did not receive proper treatment for a drug-resistant infection while in a foster home.

The state previously dismissed a claim against the agency, and a spokeswoman for the department said it would not comment on pending litigation. The foster care provider says the girl did receive treatment.
