Former Edmonds cop convicted of custodial sexual misconduct
EVERETT -- Former Edmonds police officer Daniel Lavely is facing up to a year in jail after being convicted of having sex with a woman who he had taken into custody.
Lavely, 48, will also be required to register as a sex offender afterwards, the Everett Herald reported.
The newspaper said that Lavely shook his head when the Snohomish County Superior Court jury's verdict was announced Thursday and his girlfriend collapsed to her knees.
Lavely was convicted of first-degree custodial sexual misconduct. He is to be sentenced Sept. 23.
He resigned from the Edmonds Police Department in January after an internal investigation was completed.
The 30-year-old woman said that Lavely removed her from an Edmonds motel room on May 7, 2012, and drove her to a parking lot, where, she told jurors, she agreed to have sex with him because she was afraid of him.
According to the Everett Herald, Lavely testified for three hours and denied having sex with the woman. He said she propositioned him for sex while she was in the back of his patrol car, and that he dropped her off behind a store to get her out of his patrol car. He admitted he could have arrested her for soliciting for sex, but said he was too upset and uncomfortable.
